1. Acceptance of Terms
Welcome to survex.app. By using this site, registering as a Survex member, participating in the membership points program, or taking part in any questionnaire or study provided or offered by Survex (individually, a "Questionnaire" and collectively, "Questionnaires"), you agree to these Terms of Use and Admission ("Terms") and confirm that you have read and accepted our privacy policy ("Privacy Policy"). Our Privacy Policy sets out how Survex collects and stores your personal information. If you do not agree with our Terms or our Privacy Policy, please refrain from using this site. Survex reserves the right, at its sole discretion, to change, modify, add to, or remove portions of these Terms, including our Privacy Policy, at any time. It is your responsibility to review these Terms periodically for any changes. These Terms were last updated on the date shown at the beginning of these Terms. Your continued use of this site after the posting of such changes will constitute your acceptance of and agreement to them. In compliance with these Terms, Survex grants you the personal, non-exclusive, non-transferable, and limited privilege of accessing and using this site.
2. Account Eligibility and Registration
To register and participate in Survex, you must: Be at least eighteen (18) years of age or the age of majority in your jurisdiction, whichever is higher. Provide accurate, current, and complete registration information. Maintain only one (1) account per individual, household, device, and IP address, unless expressly authorized in writing by Survex. Survex strictly prohibits: Multiple accounts. Account sharing. Use of VPNs, proxies, residential RDPs, emulators, virtual machines, or any technology designed to mask identity or location. Use of automated scripts, bots, AI tools, or software to manipulate surveys or offers. We reserve the right, at our sole and absolute discretion, to verify your identity at any time, including requesting identification documents, proof of residence, or additional verification measures. If we determine that you have provided false information, misrepresented your identity, manipulated eligibility criteria, or violated these Terms, we may immediately suspend or permanently terminate your account without prior notice and without liability. Survex may use automated decision-making systems, fraud scoring mechanisms, and behavioral analysis tools to evaluate account risk and enforce these Terms.
3. Survey Participation
You agree that you will not engage in any activity or conduct that interferes with or disrupts the Survex Sites and Features or our Services (or the servers and networks connected to our Services), nor will you use any service to manipulate your computer, mobile phone, or other device to gain advantages in any of our Rewards Programs. Unless specifically permitted in a separate written agreement with us, you agree not to reproduce, duplicate, copy, sell, trade, or resell our Services for any purpose. Furthermore, you agree that your use of the Survex Sites, Features, and Services will not be fraudulent, deceptive, or illegal, as determined at our sole and absolute discretion. You must also comply with all rules and usage guidelines found on the Survex Sites or within our Services, which includes: Prohibited Activities Unauthorized Access: Accessing (or attempting to access) any of our Services through means other than the interfaces we provide. Account Sharing: Sharing a single Account with another person. Multiple Accounts: Creating or using multiple Accounts (only one Account per person is allowed in each Rewards Program). Identity Misrepresentation: Maintaining or using a false identity or multiple identities, or failing to participate using your real identity and accurate contact/demographic information. This includes using technology (such as VPNs, proxies, one-time mobile numbers, or fake IDs) to hide your real identity/location or bypass access controls. False Information: Submitting personal info (name, email, zip code, etc.), payment info (credit card numbers), or other data that we determine to be false, inaccurate, or invalid. Inappropriate Content: Posting or transmitting information that is obscene, indecent, profane, pornographic, hateful, or otherwise objectionable. Spamming: Posting or promoting unwanted links, redirect links, or personal referral links excessively or in a misleading/inappropriate manner, including the use of paid advertisements. Harassment: Defaming, slandering, mocking, harassing, threatening, stalking, or abusing anyone, or acting in a belligerent or offensive manner. Malicious Software: Uploading or transmitting files containing viruses, Trojans, worms, time bombs, corrupted data, or any software that may damage the operation of our Services or other users' computers. Rights Infringement: Violating contractual, personal, intellectual property, or other rights (ours or third parties'), including infringing on trademarks, copyrights, or patents. Phishing: Attempting to obtain Account information, passwords, or private info from other members. Support Abuse: Misusing support channels to file false reports, claiming rewards you are not entitled to, or communicating with customer service in a disrespectful or offensive manner. Fraudulent Evidence: Creating or distributing altered or false images/documents to claim Rewards. Automation & Cheats: Developing or using "automated" software, macros, web crawlers, scripts, or "cheat utilities" in connection with the Services. Survey Manipulation: Sharing survey IDs, answers, or confidential survey information, or assisting others in meeting survey requirements. Artificial Activity: Performing offers in an artificial or "rigged" way that does not reflect organic human use. This includes using botnets, click farms, unauthorized AI/chatbots, or excessive searching to inflate Rewards. Exploiting Errors: Publicly reporting or exploiting any "Bug" or error that provides an unintended advantage or violates laws. If you find an error, you must notify our support team. If we determine, at our sole and absolute discretion, that you have violated these Terms, we may issue a warning before canceling or suspending your Account. However, you acknowledge that we are not required to provide a warning or notice before termination, which we may do at any time and for any reason. If your Account is canceled or suspended, you agree not to attempt to rejoin or create a new Account in any of our Rewards Programs without our prior written authorization. Immediate Termination and Forfeiture: If Survex determines, at its sole discretion, that you have engaged in fraudulent activity, abuse of surveys, artificial participation, identity manipulation, or violation of any partner requirements, Survex may immediately terminate your account, withhold pending rewards, reverse previously credited rewards, and permanently ban you from future participation. No compensation will be provided for forfeited rewards resulting from violations of these Terms.
4. Rewards and Balance
In connection with your participation in Survex, you may have the opportunity to accumulate rewards, incentives, points, entries into sweepstakes, or other promotional benefits (collectively, “Rewards”). Rewards may be issued in the form of points or Panel Currency. Panel Currency and points have no cash value, are not legal tender, are non-transferable, and may not be sold, traded, auctioned, bartered, assigned, or gifted. Rewards do not constitute property, wages, salary, compensation, or any form of employment payment. Participation in Survex activities is voluntary and incentives are provided solely to encourage engagement. Points or Panel Currency are not calculated based on time spent and are not prorated hourly or otherwise. Survex makes no guarantee that any specific survey, offer, or activity will be available at any time. All points credited to a member’s account expire one (1) year after deposit unless forfeited earlier due to inactivity, account suspension, violation of these Terms, fraud investigation, or program termination. Accounts are not financial accounts and do not accrue interest. Rewards only acquire value upon successful redemption in accordance with these Terms. If points, Panel Currency, or Rewards are credited in error, Survex reserves the right to remove them without notice. If Rewards are obtained through fraudulent, deceptive, artificial, automated, or unauthorized means, Survex may remove such Rewards and suspend or permanently terminate the associated account. Fraud Review and Payment Holds Survex reserves the right to place temporary holds on rewards, withdrawals, or redemption requests for fraud review, identity verification, partner validation, compliance checks, or chargeback investigation. Processing times may vary depending on third-party partner confirmation procedures. Survex may delay, reverse, adjust, or cancel Rewards if: A partner reports invalid, duplicate, or fraudulent participation. Survey qualification criteria were manipulated. VPN, proxy, emulator, AI automation, or identity masking tools were detected. Chargebacks, disputes, or reversed transactions occur. Suspicious activity is identified during internal review. Survex is not responsible for delays caused by partner review processes. Redemption Terms Redemption requests will deduct the corresponding points at the time the request is submitted. All redemptions are final once processed and may not be reversed except at Survex’s sole discretion. The minimum redemption threshold is twenty US dollars (USD $20), unless a lower threshold option is offered at Survex’s discretion. Members may not combine, pool, or transfer Rewards between accounts, including family members or other individuals. Daily redemption is limited to two (2) redemptions per 24-hour period. Survex reserves the right to modify, suspend, restrict, or terminate any Reward program, redemption option, conversion rate, or eligibility requirement at any time without prior notice. Forfeiture of Rewards If an account is suspended, terminated, or found to be in violation of these Terms, all pending, unused, or unredeemed Rewards may be forfeited without compensation. In the event of account closure initiated by the user, any unredeemed Rewards may be forfeited. Survex’s decisions regarding reward eligibility, validation, and forfeiture are final and binding. Third-Party Rewards Disclaimer Certain Rewards may be fulfilled by third-party providers. Survex makes no representations or warranties regarding third-party products or services, including merchantability, fitness for a particular purpose, quality, availability, or delivery. Survex is not responsible for: Lost, stolen, delayed, or damaged rewards. Errors made by third-party reward providers. Taxes imposed by any authority. Technical failures affecting redemption. Members are responsible for reviewing any applicable third-party terms. Limitation on Liability for Rewards In no event shall Survex’s total liability relating to Rewards exceed the total amount of Rewards redeemed by you in the six (6) months preceding the claim. Chargeback Responsibility If Survex incurs losses, penalties, partner clawbacks, processing fees, or administrative costs resulting from a chargeback, payment dispute, reversed transaction, fraudulent activity, or violation of partner requirements attributable to your account, you agree that Survex may recover such amounts by deducting from your Rewards balance or pursuing recovery through lawful means.
5. Limitation of Liability
You agree that your use of Survex Sites and features, as well as our Services, shall be at your own sole risk. To the maximum extent permitted by applicable law, the Company shall be released from liability regarding any and all warranties, promises, and representations, express or implied, in connection with Survex Sites and features, or our Services, and your use thereof, including implied warranties of title, merchantability or acceptable quality, fitness for a particular purpose or non-infringement, accuracy, authority, integrity, usefulness, and relevance. To the maximum extent permitted by applicable law, the Company makes no warranties, promises, or representations as to the accuracy or completeness of the content of the Survex Sites and features or our Services, nor the content of any site linked to our Services, and assumes no liability or responsibility for errors, failures, or inaccuracies of content, personal injury (including death) or property damage, of any nature whatsoever, resulting from your access to and use of the Survex Sites and features or our Services (other than those caused solely by our negligence), or any third-party product or service promoted therein, unauthorized access to or use of our secure servers and/or personal and/or financial information stored therein, interruption or cessation of transmission to or from the Survex Sites and features or our Services, bugs, viruses, Trojan horses, or the like which may be transmitted to or through our Services by any third party, errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Survex Sites and features or our Services, tax obligations imposed against you by any tax authority, (viii) any user submission or the defamatory, offensive, or illegal conduct of any third party, any loss of business suffered by you or any third party, and/or any loss that was not reasonably foreseeable. You acknowledge and agree that Survex is not affiliated with, nor responsible for, any third-party product or service displayed, disseminated, or generally promoted on the Survex Sites and features or our Services. Survex does not represent or endorse the quality, accuracy, reliability, integrity, or legality of third-party products or services, nor the veracity or accuracy of the description of third-party products or services, nor any third-party advertising material, including Offers, advertisements, links, content, advice, opinions, proposals, statements, data, and other information provided or controlled by third parties and displayed, disseminated, or otherwise used in, or in connection with, the Survex Sites and features or our Services. Furthermore, you agree that the Company shall not be liable for, nor have any obligation to offer any compensation with respect to, the cancellation of any Rewards Program or associated Account, including, but not limited to, unredeemed Rewards in your Account or existing in your favor at the time of cancellation. If so, these Conditions do not affect your legal relationship with those other companies or individuals. You agree that we are not responsible for the loss or defectiveness of any past, present, or future Reward, in the event of any change in the potential value or redemption options of any Reward, or any data or server error, computer system and/or network error or failure, criminal act, act of vandalism, cyberattack, or other events that make it not commercially reasonable for us to determine the amount of Rewards or the balance of any Account. To the maximum extent permitted by applicable law, all warranties, promises, and representations, whether express or implied, as to the condition, suitability, quality, fitness, or safety of any product and service provided under our Rewards Programs or other Services are excluded. Any liability that the Company may have to a member under such implied or statutory warranties or representations that cannot be excluded shall be limited, to the extent permitted by law, to supplying or paying the cost of supplying the products or services (or equivalent products or services) or repairing or paying the cost of repairing the products or re-performing the services, at the Company's sole discretion. Please note that we may, at any time and at our sole and absolute discretion, terminate our legal agreement with you and deprive you of continued use of the Survex Sites and features and our Services and, without limiting the foregoing, we may do so if required by law (for example, where the provision of our services is or becomes illegal). The partner through whom we offered our Services has terminated their relationship with us or has ceased to offer their services to you, we no longer provide all or part of our Services to users in the jurisdiction in which you reside or from which you use our Services, or the provision of our Services to you, in our opinion, is no longer commercially viable.
7. Independent Contractor Status
Participation in Survex surveys, reward programs, or research activities does not create any employment, partnership, agency, or joint venture relationship between you and Survex. Rewards, points, or incentives are not wages, salary, or compensation for employment, and participation is entirely voluntary.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the use of Survex Services shall be resolved exclusively through binding arbitration conducted in Illinois, except that either party may bring claims in small claims court if eligible. By agreeing to these Terms, you waive your right to participate in class actions or class-wide arbitration.
9. Indemnification
You agree to defend, indemnify, and hold harmless Survex, its affiliates, partners, officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorneys’ fees) arising from: Your use of the Survex Sites or Services; Your violation of these Terms; Your fraudulent activity or abuse of Rewards Programs; Your violation of any third-party rights, including survey partners; Any chargeback, payment dispute, or reversal caused by your actions. Survex reserves the right to assume exclusive defense and control of any matter subject to indemnification.
10. Severability
If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
11. Changes to Terms
We reserve the right to modify these Terms from time to time, at our sole and absolute discretion. If we decide to modify them, we will notify you of such changes by means of an administrative email or by posting them on the Survex Sites and Features that we deem appropriate, so that our users are always aware of the terms of use of the Survex Sites and Features and our Services. Your continued use of the Survex Sites and Features or our Services after receiving the administrative email or after the posting of the changes constitutes your acceptance of them. If you do not agree with the changes, please close your Account and discontinue your use of the Survex Sites and Features and our Services. To the extent an arbitrator (or a small claims court, if applicable) determines that applying any changes to these Terms to prior events or circumstances would render this agreement illusory or unenforceable, such changes will apply only prospectively, with respect to events or circumstances occurring after the date of such changes, to the extent necessary to prevent these Terms from being deemed illusory or unenforceable. In any event, if you used any of the Survex Sites and Features or our Services pursuant to a prior version of these Terms that required a notice period prior to the effective date of any changes, the changes under these Terms will not take effect until such notice period has expired after the date of these Terms.
